José Curruchiche Cucul est le chef du bureau du procureur spécial contre l’impunité (FECI), qui opère sous l’autorité du ministère public (Ministerio Público) du Guatemala (équivalent du parquet). Sous sa direction, le FECI est à l’origine de l’enquête en cours sur la création du parti politique du président Arévalo, Movimiento Semilla. Il a participé personnellement à la perquisition menée par le ministère public dans les locaux du Tribunal suprême électoral, qui a entraîné l’ouverture d’urnes scellées. En outre, il a participé à la demande de suspension de la personnalité juridique de Movimiento Semilla en juillet 2023. Par ailleurs, en décembre 2023, il a participé à une conférence de presse au cours de laquelle le ministère public a fait valoir que les résultats du premier tour des élections, tenu en juin 2023, étaient invalides. Il a été personnellement impliqué dans les enquêtes et poursuites fallacieuses visant des autorités démocratiquement élues, d’anciens représentants des médias (comme le journaliste José Rubén Zamora), ainsi que des professionnels de la justice, en particulier les enquêtes et poursuites fallacieuses de ceux qui ont lutté contre la corruption et l’impunité auprès de la Commission internationale contre l’impunité au Guatemala (CICIG). Par ces actions, José Curruchiche Cucul participe aux efforts visant à annuler les résultats des élections de 2023 au Guatemala. Il est donc responsable d’actions portant atteinte à la démocratie, à l’état de droit et à une passation de pouvoir pacifique au Guatemala.

Asset freeze, travel ban and director disqualification sanction

There are reasonable grounds to suspect that José Rafael Curruchiche Cucul ('Curruchiche') is an involved person within the meaning of the Global Anti-Corruption Sanctions Regulations 2021 on the basis of the following grounds: (1) Curruchiche is or has been involved in serious corruption by being responsible for or engaging in serious corruption. Whilst a prosecutor within the Public Ministry (Ministerio Público, MP), a foreign public official exercising a judicial function, he accepted a promotion to Head of the Special Prosecution Office Against Impunity (Fiscalía Especial contra la Impunidad, FECI). He did so in anticipation of him improperly performing a public function as Head of the FECI, intentionally undermining corruption investigations into the Guatemalan political elite. (2) Curruchiche is or has been involved in serious corruption, by being responsible for the investigation or prosecution of serious corruption and intentionally failing to fulfil that responsibility. Whilst a prosecutor within the MP, a foreign public official exercising a judicial function, he accepted a promotion to Head of the FECI. He did so in anticipation of him improperly performing a public function as Head of the FECI, intentionally undermining corruption investigations into the Guatemalan political elite. (3) Curruchiche is or has used threats or intimidation to interfere in a law enforcement or judicial process in connection with serious corruption. Whilst a prosecutor within the MP, a foreign public official exercising a judicial function, he accepted a promotion to Head of the FECI. He did so in anticipation of him improperly performing a public function as Head of the FECI, intentionally undermining corruption investigations into the Guatemalan political elite.
