Refund Policy

This Refund Policy explains the circumstances under which NexGlobal LLC, operating NexScreening under NexSystems ("NexScreening," "we," "us," or "our"), may issue refunds in connection with the use of the NexScreening services ("Services").
This Refund Policy forms part of the NexScreening Terms and Conditions.
1. General Refund Policy
1.1 NexScreening provides access to digital compliance screening services, including sanctions screening, PEP screening, adverse media screening, and passport checks.
1.2 Due to the nature of the Services, which are immediately accessible upon activation, fees paid are generally non-refundable, except as expressly stated in this Refund Policy or required by Applicable Law.
1.3 By purchasing or using the Services, the Customer acknowledges and agrees to this Refund Policy.
2. No Refunds for Used Services
2.1 Fees paid for Services that have been accessed, used, or consumed are non-refundable.
2.2 This includes, without limitation:
- completed or partially completed screenings;
- API calls or transactions;
- access to screening results or reports;
- usage during any billing period.
2.3 The Customer acknowledges that once Services are used, NexScreening incurs operational and data processing costs that cannot be reversed.
3. Subscription and Prepaid Plans
3.1 For subscription-based or prepaid plans:
- fees are charged in advance for the applicable billing period;
- unused time, credits, or capacity are not refundable.
3.2 Cancellation of a subscription will take effect at the end of the current billing period unless otherwise stated in a separate agreement.
3.3 No partial or prorated refunds are provided for early termination, except where required by Applicable Law or expressly agreed in writing.
4. Trial Access and Demonstrations
4.1 NexScreening may, at its discretion, offer trial access, demonstrations, or limited testing environments.
4.2 Trial access is provided free of charge and does not entitle the Customer to a refund.
4.3 Any usage beyond trial limitations is subject to standard fees and this Refund Policy.
5. Service Unavailability
5.1 NexScreening does not guarantee uninterrupted or error-free access to the Services.
5.2 Temporary outages, maintenance windows, or performance degradation do not entitle the Customer to a refund.
5.3 Refunds or service credits for extended unavailability may be considered solely at NexScreening's discretion, unless otherwise agreed in writing.
6. Billing Errors
6.1 If the Customer believes a billing error has occurred, it must notify NexScreening in writing within thirty (30) days of the invoice date.
6.2 NexScreening will investigate the claim and, if an error is confirmed, may issue:
- a refund; or
- a billing adjustment or credit.
6.3 Failure to notify NexScreening within the specified timeframe constitutes acceptance of the charges.
7. No Refunds Based on Screening Outcomes
7.1 NexScreening does not issue refunds based on:
- dissatisfaction with screening results;
- false positives or false negatives;
- regulatory outcomes or compliance decisions;
- business, legal, or financial consequences arising from use of the Services.
7.2 The Customer acknowledges that screening results are informational and subject to limitations as described in the Terms and Conditions.
8. Termination for Breach
8.1 If access to the Services is suspended or terminated due to:
- breach of the Terms and Conditions;
- misuse of the Services;
- violation of Applicable Law,
the Customer is not entitled to any refund.
9. Legal and Regulatory Exceptions
9.1 Nothing in this Refund Policy limits any mandatory refund rights granted under Applicable Law.
9.2 Where consumer protection laws apply and cannot be excluded, refunds will be provided in accordance with such laws.
10. Changes to This Refund Policy
10.1 NexScreening reserves the right to modify this Refund Policy at any time.
10.2 Changes will be effective upon publication on the Website or notification to the Customer.
10.3 Continued use of the Services constitutes acceptance of the updated Refund Policy.
